EHRC code of practice for services, public functions and associations

The code of practice provides guidance on the Equality Act 2010 (the Act) and helps courts, lawyers, advisers and others interpret and comply with the law. It does not make new law or create any new legal obligations. The code was laid in Parliament for 40 days from 21 May to 9 July. It became statutory on 5 August.

Critical Updates in the New Draft include:

  • Updated definitions of “sex”, “woman”, “man” and “trans” for the purposes of the Equality Act 2010
  • New content on gender reassignment regarding protections for children and young people, and people with non-binary or gender fluid identities
  • New content on gender recognition certificates for the purposes of the Equality Act 2010
  • New content about asking about sex at birth and where this may or may not be justified
  • Updated definition of the protected characteristic of sexual orientation
  • New / updated examples of sex discrimination
  • New / updated sections on competitive sport and single-sex services
  • New content on separate or single-sex services in relation to gender reassignment
  • Information about protections for women whose menopause has had a significant impact on their daily life
